Terms of Service

1.What Babe Pay is

Babe Pay lets creators upload photos and videos, group them into a "drop", set a price and share one link. Visitors see blurred previews, pay once, and the drop unlocks for them. Babe Pay is not a subscription service, a social network or a messaging app.

Babe Pay provides the software and the payment tools. The sale itself is between the creator and the buyer. We are not a party to the content a creator sells, and we do not promise that any particular drop is accurate, lawful or to your taste.

2.Who can use Babe Pay

You must be at least 18 years old (or the age of majority where you live, if higher) to create an account or to buy a drop. Babe Pay is not meant for children.

You must be able to form a binding contract, and you must not be on a sanctions list or located in a country or region that is subject to comprehensive sanctions. If you use Babe Pay for a business, you confirm that you can bind that business to these terms.

Each person should keep one creator account. Do not create accounts to get around a suspension, a limit or a ban.

3.Your account

Creators sign up with an email address and password, or with Google or Apple where available. Buyers do not need an account: they pay with an email address and receive an access link.

Give us true and current information and keep your login details secret. You are responsible for what happens under your account. Tell us right away at access@babepay.app if you think someone else has used it.

4.If you are a creator: your content

You keep ownership of everything you upload. By uploading, you give Babe Pay a worldwide, non-exclusive, royalty-free licence to host, copy, process, display and deliver your content, only so that we can run the service for you and your buyers. Processing includes compressing and converting files, cropping, creating blurred previews, posters and teasers, and removing location and camera metadata. The licence continues for as long as buyers who purchased the content need access, and for a reasonable time after that for backups.

You promise that you own the content or have every right and permission needed to sell it, that everyone who appears in it is an adult who agreed to be photographed or filmed and to have the content sold, and that it follows our Content Policy and the law. You are responsible for your content, your titles and descriptions, and your prices.

Free items and blurred previews are visible to anyone who has your link. Only mark as Free what you are happy to show publicly.

You decide whether buyers may download a drop. When downloads are off, the Babe Pay viewer does not offer a download button, but we cannot stop someone from photographing or recording their own screen. We do not add watermarks.

5.If you are a creator: fees, payouts and taxes

Babe Pay charges a platform fee of 8.5% of each sale, with no fixed fee per sale, no monthly fee and no fee added to the buyer's checkout. Payment processing costs may apply and, where they do, are shown in your dashboard. We may change fees for future sales after giving you notice.

Card payments are not offered yet. Checkout is in stablecoins.

Where crypto checkout is offered, sales paid in stablecoins are added to a separate crypto balance that you can withdraw to a wallet address you confirm. Withdrawals have limits, holds, minimums and network fees that are shown in your dashboard. A crypto balance is not a bank account, earns no interest and is not insured.

We may delay, reduce or hold payouts and withdrawals, and may deduct amounts you owe us (for example refunds and chargebacks), when we reasonably suspect fraud, a breach of these terms or the law, a high risk of disputes, or when a payment partner or a legal order requires it. We will tell you when we do, unless the law or an investigation prevents us.

While we investigate a possible problem (for example fraud, chargebacks, a report about your content or a request from a payment partner or authority), we may place a hold on your funds. During a hold your drops can keep selling unless they were taken down, and your balance keeps growing, but withdrawals and payouts are paused until we release the hold. A hold does not take money away from you: if the investigation finds nothing wrong, we release the full balance. We will tell you about the hold and how to contact us at access@babepay.app.

Sales are not available to withdraw or pay out straight away. Each sale stays pending for a waiting period shown in your dashboard, which is longer for new creators (for example 14 days while your account is new or has few sales, and 7 days after that). We may change these periods for future sales, and the waiting period is in addition to any hold described above.

You are responsible for your own taxes. Depending on where you and your buyers are, tax rules may apply to your sales, and we may be required to collect information about you or report your earnings.

6.If you are a buyer

When you pay, you get a personal, non-exclusive, non-transferable licence to view the unlocked content for yourself, and to download it only where the creator has allowed downloads. You may not copy, resell, share, post or publish it, or give your access link to other people.

Your access link is sent to the email address you gave at checkout. It works on up to 3 devices. Keep it private. If you lose it, use "Lost your link?" on the drop page.

The creator owns the content. Babe Pay does not review every item before it is sold and cannot promise what a locked item contains beyond what its preview and description show.

7.Payments, refunds and crypto

Prices are in US dollars. Because the content unlocks immediately, sales are generally final. The Refunds & Payments page explains when we refund, how chargebacks work, and the special rules for crypto payments (including wrong network, late and underpaid transfers). It is part of these terms.

8.Rules of use

Your use of Babe Pay must follow our Content Policy and the law. You also must not:

• break, bypass or probe our security, blurring, access limits or device limits, or access content you have not paid for or that belongs to someone else;
• scrape or copy the service, use bots, or put an unreasonable load on it;
• upload malware or anything meant to harm other people's devices or data;
• pretend to be another person or organisation, or give false information;
• use Babe Pay to launder money, evade sanctions, commit fraud, or take part in chargeback abuse;
• send spam, or use buyer email addresses for anything other than delivering and supporting their purchase;
• reverse engineer the service, except where the law lets you.

9.Moderation and removals

We are not required to review content, but we may. We may take down or disable any drop, item, preview, link or account, with or without notice, if we believe it breaks these terms, the Content Policy or the law, if a payment partner requires it, or to protect people. A drop that is taken down is hidden from its public page and cannot be bought. People who already bought it normally keep their access. For serious cases (for example illegal content, content involving a minor, or content shared without consent) we may also block access for people who already bought it, and we may refund them.

Anyone can report a drop with the Report button on its page (no account needed) or by writing to access@babepay.app. Copyright complaints follow the process in the Content Policy. We may share information with law enforcement where we think the law requires it or where someone may be at risk.

10.Deleting content and closing accounts

Creators can delete items and drops that have never been sold. Those files are permanently removed.

A drop or item that has been sold is hidden from new visitors but is not erased, so that buyers keep the access they paid for. The creator cannot take it back. The exceptions are content that we remove under the section above, and the end of the service (see "Changes to Babe Pay").

You can ask us to close your creator account at access@babepay.app. We may keep sold content online for existing buyers and keep the records we need for legal, tax, fraud and accounting reasons. Any remaining balance is paid out where we are able to do so, after deducting what you owe.

11.Suspension and ending these terms

You can stop using Babe Pay at any time. We can suspend or end your access if you break these terms, if your use creates risk or legal exposure for us, buyers or payment partners, or if the law requires it. For serious breaches (for example anything involving minors, non-consensual content or fraud) we may act immediately and report you to the authorities.

Sections that by their nature should survive (such as content licences needed for buyers' access, fees owed, disclaimers, liability limits and dispute rules) continue after the terms end.

12.Privacy

How we handle personal data is described in our Privacy Policy, which forms part of these terms.

13.Our rights

Babe Pay, its software, design, name and logo belong to us or our licensors. We give you a limited, revocable, non-transferable right to use the service as these terms allow. If you send us feedback, we may use it without owing you anything.

14.Third-party services

Babe Pay works with services we do not control, such as Google and Apple sign-in, email delivery, hosting, wallets and public blockchains. Their terms apply to your use of them, and we are not responsible for their outages, errors or decisions.

15.Disclaimers

Babe Pay is provided "as is" and "as available". To the fullest extent the law allows, we do not give any warranty, including for fitness for a purpose, uninterrupted service, or that content will be free of errors or that security measures can never be circumvented. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

16.Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability to you for all claims relating to Babe Pay is limited to the greater of (a) the fees we received from you in the 12 months before the claim and (b) 100 US dollars.

These limits do not apply to liability that cannot be excluded by law, such as for fraud, or for death or personal injury caused by our negligence.

17.Indemnity

If you are a creator, you will defend and compensate us and our team against claims, losses and costs (including reasonable legal fees) that arise from your content, your sales, or your breach of these terms or the law.

18.Changes to Babe Pay and to these terms

We may change, pause or end features, or the whole service. If we plan to shut Babe Pay down, we will give notice and, where we reasonably can, a way for buyers to keep the content they bought.

We may update these terms. For important changes we will post the new version here with a new date and, where we can, tell you by email or in the product, normally at least 14 days before the change applies. If you keep using Babe Pay after that, you accept the update. If you do not agree, stop using Babe Pay.

19.Disputes

Before starting a formal claim, please write to us at access@babepay.app and give us 30 days to try to solve the problem.

20.General

These terms, together with the Content Policy, the Refunds & Payments page and the Privacy Policy, are the whole agreement between you and us about Babe Pay. If a part is found unenforceable, the rest stays in force. If we do not enforce something right away, we are not giving up that right. We may transfer these terms in a merger, sale or reorganisation. You may not transfer them without our consent.

We may provide these terms in several languages for convenience. If the translations differ, the English version controls, unless the law of your country requires otherwise.
